No hardcopy of Docs needed, know new Motor Vehicle Act rules effective from Oct 1 2020

  • New Delhi: Many new motor vehicle rules, Central Motor Vehicles (Eleventh Amendment) Rules, 2020, aimed at making the life of commuters and safer came into force from October 1.
  • The Union Ministry of Road Transport notified the changes to the Motor Vehicle Act, 1989, last week which pertained to carrying documents physically, use of mobile phones while driving among others.
“Ministry of Road Transport & Highways (MoRTH) has recently issued notifications regarding various amendments in Central Motor Vehicle Rules 1989 requiring the implementation of enforcement, Maintenance of Vehicular Documents and E-Challans through portal w.e.f 1.10.2020 for better monitoring and enforcement of MV Rules,” MoRTH said in a statement earlier.
  • The Motor Vehicle Act was implemented last year in a bid to strengthen transport rules and regulations in the country and revamp the rules regarding penalties for traffic rule violation and upgrading the technology to curb corruption in the department.
  • In the wake of coronavirus pandemic, MoRTH also extended the deadline for validity of the driving license and other motor vehicle documents till December 31.
    “To reduce inconvenience due to the following of social distancing norms during COVID-19 outbreak, MoRTH has issued an advisory to all state governments to further extend the validity of the documents related to Motor Vehicles Act 1988 and Central Motor Vehicle Rules 1989,(Amendment) Act, 2019 (32 of 2019),” Union Minister of Road Transport & Highways Niin Gadkari said in a statement earlier.

  • Use of handheld communications devices while driving shall solely be used for route navigation in such a manner that shall not disturb the concentration of the driver while driving. In other words, the use of mobile phone is only permitted for navigation purposes only and no other task while driving.
  • Motor vehicle owners can maintain their documents on central government’s online portals like Digilocker or m-parivahan.
  • Motor Vehicle documents such as registration certificates (RC), insurance, fitness and permit, the driving licence certificate for Pollution Under Check (PUC) that are validated electronically cannot be demanded for for physical inspection by the authorities including in cases where there is an offence made out necessitating seizure of any such documents.
  • In cases where there is an offence made out necessitating seizure of any documents, the authorities can do so only electronically and will not demand any physical documents. Upon seizing any documents, the police officer in uniform or any other officer, authorised by the State Government shall issue a receipt acknowledging such seizure, in physical or electronic form.
